Terms and Conditions for Hotels and Hotel Apartments

Booking Conditions

Worldwide Hotels Online.com are acting as booking agents only on behalf of all the hotels and hotel apartments that are featured on this web site. All completed reservations are received by Worldwide Hotels Online and NOT the individual hotel. These terms and conditions apply to all members of your party, so please print a copy of this page and ensure that all members of your party are made fully aware of them. All information, descriptions and images are supplied to us by the relevant hotel or third party supplier and thus are believed to be true and accurate and are displayed for educational purposes. Images on this web site are incorporated for viewing purposes only and may not be saved, downloaded or printed in any format.

Your Contract

As soon as you have made your reservation for accommodation at the hotel or apartment of your choice, you will be issued with a confirmation that the booking has been processed. We will then issue you with a hotel voucher and this will be sent to you by email. It is at this point that a binding contract comes into force and the accommodation provider is responsible to you to provide you with what you have booked and paid for, subject to these booking conditions. It is therefore very important to check all the details on the hotel voucher when you receive it. We will ask you to confirm receipt and also that all the information is correct and as requested. If you want to cancel or change your booking later, you may have to pay amendment or cancellation costs (as described below) which may be as much as the whole accommodation cost. The person making the booking, known as the 'lead name', accepts responsibility for all members of the party, for ensuring that payments are made, and will be the person to whom we will send the hotel voucher to. It is also the 'lead name' that we will contact if any new information needs to be passed on or in case of any emergencies. Should you wish to make an amendment or cancel your booking, the 'lead name' must notify us by e-mail, or in writing, as soon as possible. If you are aged under 18 on date of departure, and your parents or guardians are not travelling with you, they must write to us with their written consent and also bear any responsibility for your conduct.

Changes to your accommodation

If you want to change any details of your booking after we have sent your confirmation, we will do our best to help. However, the accommodation provider has no obligation to make any change. If the accommodation provider is able to make the change, there will be a Worldwide Hotels Online administration charge of GB£25.00 per booking alteration plus any potential charges from the accommodation provider, subject to their terms and conditions, and we will inform you of these charges before making the alteration.

If you change the total number of people booked, the accommodation price will be re-calculated for the new party size, as this may mean that accommodation is either under-occupied or over-occupied and each of the remainder of your party may have to pay more. If you wish to change your booking during your holiday, ie. extending your stay or upgrading your accommodation or meal basis, all requests are subject to availability and any extra payment must be paid locally. All extras, such as mini-bar, telephone charges etc, must be paid for locally prior to your departure from the accommodation.

Special Requests

If you have any special requests such as infant cots, dietary requirements, room location, late check-out etc., please enter these details on the booking. We will inform the accommodation provider of all such requests but unfortunately we cannot guarantee that these requests will be met. If the accommodation provider is unable to meet such requests, neither we nor they can have any liability to you in this respect. Cots for infants under 2 years of age must be requested. Some hotels may charge you a nominal fee and all such charges are paid locally direct with the hotel/apartments upon your arrival. Infants should not be included in the number of children as they will then be charged the child rate. Please note that some rooms will not be large enough to accommodate two adults, one child AND one infant. In such cases it is best to search for a room by including the infant as a child, ie, two adults and two children. Once you have selected which hotel you wish to book, search again but only submit two adults and one child. On the booking details, please request an infant cot and enter the infants age at the time of travel in the section 'SPECIAL REQUESTS'.

Holiday Insurance

We strongly recommend that you and all members of your party take out the appropriate travel/holiday insurance at the same time or before booking your accommodation. It is your responsibility to check that your insurance covers, amongst other things, the cost of cancellation by you, all medical costs and the cost of assistance including return to your country of residence in the event of an accident, illness or death.

Our Responsibility to you for your booking

Because we are acting as a booking agent only, we have no liability for any of the accommodation arrangements, and in particular no liability for any personal injury, illness, death or loss of any kind. Any claim for damages for injury, illness or death arising from your stay in the accommodation, must be brought against the owner of the accommodation and will be under the jurisdiction of the law of the country in which the accommodation is based. Also we, or the accommodation provider, have no liability for providing extended stays, late check-outs, early check-ins or cancellations due to any changes in your flight times or in the rare event of your flight being cancelled altogether.

General Cancellation Charges

If you wish to cancel your booking, we must receive written confirmation from the 'lead name' as soon as possible. Cancellation charges will come into effect as soon as the booking has been confirmed and a hotel voucher has been issued. The closer it is to the time of your planned holiday, the less likely they are to re- sell it. Therefore, if you cancel your booking, a charge has to made and the later the cancellation, the more that charge will be. If you wish to cancel a confirmed booking, this must be done by e-mail by the 'lead name'.

When the cancellation e-mail is received by us before departure:

14 - 8 days 70%
7 days or less until departure 100%

Charges as a percentage of total accommodation booking value. If one or more members of your party cancel, this may mean that accommodation is under-occupied and the price of the remaining members of your party may be increased to reflect this. If the accommodation provider makes a change to your booking, we will inform you as soon as possible before your departure, but will have no other liability towards you. No refunds can be given for stays that are ended earlier than planned.

No-shows are not refunded.

USA cancellations

For reservations made for accommodation in the USA, please note that the cancellation policy is as follows:

More than 91 days - 25%
90 days or less - 100%

A Name change during the 90 day period will be considered as a cancellation with full cancellation charges being applicable.

Worldwide Hotels Online.com will do everything in its power to avoid having to make any changes to your booking. If in the unlikely event that we are informed by the accommodation provider that they are unable to provide the accommodation which you have booked, we will try to provide you with similar accommodation of equal standard. However, if we are unable to do this or you prefer not to accept our alternative offer, you may cancel free of charge.

Complaints

If you have a valid complaint whilst you are staying at the accommodation you have booked, you MUST inform the accommodation management immediately, in order to give them the opportunity to resolve the problem.

Room Allocation

After registration upon your arrival at the accommodation, you will be allocated a room. Please note that check-in time is usually after 14.00 hours and check-out time is usually 12 noon. Please bear this in mind when booking your flight, especially when travelling on night flights, e.g. if you are due to arrive at the airport during the early hours of the morning, you will be required to book your accommodation for the previous night if you wish to access your accommodation before 14.00 hours on your arrival date. Similarly, if you are departing the airport late in the evening or early in the morning, you will be required to check-out at 12 noon unless arrangements have been made for a late check-out (usually available at an additional fee, subject to availability - however, this must be organised locally upon your arrival).

Indemnity

When you book accommodation through Worldwide Hotels Online.com, you accept responsibility for the proper conduct of yourself and all members of your party during your stay. You are also liable to make a reimbursement to the accommodation provider for any damage caused before you end your stay. The accommodation provider reserves the right at any time to terminate your holiday or that of any member of your party due to misconduct by that person, within their reasonable opinion. Full cancellation charges will apply and no refund will be given. Furthermore, the accommodation provider shall be under no obligation whatsoever to pay compensation or meet any costs or expenses you may incur as a result of the booking being terminated, in accordance with this paragraph. If your actions, or those of any member of your party, cause damage to the accommodation in which you are staying, you agree to fully indemnify us against any claim, including legal costs, made against the accommodation provider.

Quoted Rates

All rates quoted to you are per room for the entire length of your stay and for the total number of adults/children selected and include all applicable taxes, unless otherwise stated. You must ensure that you have submitted the correct number of persons and the correct dates. Remember that the departure date is usually the same day as your return flight (unless you are travelling overnight).

Please note that if you wish to make a reservation and the rate quoted to you is in local currency, we will use the exchange rate provided by one of the major UK High Street banks that is valid for that day. You will therefore need to make payment that same day in order to guarantee that exchange rate. We do not use currency converters of any kind, or rates available by overseas banks, as they do not reflect the current daily exchange rate available within the UK.

Terms and Conditions for Timeshare Resorts

1.1 Information about Affiliated Resorts, including without limitation available information about facilities, amenities and services, published by WORLDWIDE HOTELS ONLINE is based on information obtained from the relevant Affiliated Resort. You should be aware that facilities, amenities and services provided at the Affiliated Resort may not necessarily be available or may be restricted at certain times of the year. Accordingly, although WORLDWIDE HOTELS ONLINE makes reasonable efforts to ensure that resort information provided by WORLDWIDE HOTELS ONLINE is accurate and complete as of the date such resort information is provided by WORLDWIDE HOTELS ONLINE to you, WORLDWIDE HOTELS ONLINE cannot accept responsibility for any inaccurate, incomplete or misleading information about any Affiliated Resort provided to you or other members of your holiday party, except in the case of negligence on the part of WORLDWIDE HOTELS ONLINE. WORLDWIDE HOTELS ONLINE makes no warranty or representation (other than any made in writing by WORLDWIDE HOTELS ONLINE) about any Affiliated Resort. You are free if you wish to make your own enquiries on such matters.

1.2 WORLDWIDE HOTELS ONLINE and Affiliated Resorts are separate and distinct entities and WORLDWIDE HOTELS ONLINE has no joint venture, partnership or agency relationship with any of them. The products or services that are provided or sold by Affiliated Resorts, including but not limited to Holiday Accommodation, are also separate and distinct.

2. REQUESTING HOLIDAY ACCOMMODATION

2.1 The person making a booking for Holiday Accommodation must be at the time of booking, at least 18 years of over for European travel, and there must be at least one member in the holiday party of 21 years or older for travel to the USA. The age limit can vary from resort to resort so please check the information carefully on the resort information page. Additionally, each person applying for a booking of Holiday Accommodation to WORLDWIDE HOTELS ONLINE warrants that he/she has the authority of all persons travelling as part of such booking to make the application on their behalf and warrants that he/she is authorised to agree and does agree on behalf of all those persons that all of the information in relevant publicity material (if any) provided to you by WORLDWIDE HOTELS ONLINE and these Terms and Conditions form part of the contract being entered into with WORLDWIDE HOTELS ONLINE. You must pay in advance the booking fee current on the date of enquiry for each apartment requested. A legally binding contract is formed when the booking is made. Confirmation of the arrangements will be sent out subsequently by WORLDWIDE HOTELS ONLINE and will be valid only if issued by WORLDWIDE HOTELS ONLINE in writing. You must check on receipt all the details on the confirmation carefully and let us know as soon as possible if anything is incorrect, as subsequent changes to any material aspect of the confirmation may be treated as a cancellation. Bookings cannot be made on a conditional basis or subject to any special requests that you may wish to make. We will endeavour to meet any special requests notified to us prior to your departure, but cannot guarantee to do so and no compensation will be payable to you if such special requests cannot be met.

3. USE OF HOLIDAY ACCOMMODATION

3.1 You and the other members of your holiday party must occupy and use any Holiday Accommodation into which you are booked in a responsible, careful and secure manner. You are responsible for any damage caused by yourself and your holiday party and must comply with the Affiliated Resort's rules and by-laws and replace any items missing from your Holiday Accommodation on departure.

3.2 The total number of people (babies and children included) occupying your Holiday Accommodation must not exceed the maximum occupancy of the apartment set out in the booking confirmation; otherwise, the Affiliated Resort may refuse access or levy an additional charge. You accept the fact that Holiday Accommodation may vary in unit size, design, fixtures, furnishings, amenities and facilities.

3.3 You and the other members of your holiday party are responsible for payment of any and all applicable taxes, personal expenses, utility charges, such as electricity, water and telephone, security deposits and other fees or charges levied by an Affiliated Resort on occupiers of Holiday Accommodation for the use of amenities and facilities thereto.

3.4 If you are going to arrive outside the check-in day and/or time set out in your confirmation, you should contact the Affiliated Resort directly to make alternative check-in arrangements. The Affiliated Resort may levy a charge or impose other conditions for any Holiday Accommodation not covering the days specified on the confirmation.

3.5 Affiliated Resorts may, where necessary, allocate alternative Holiday Accommodation to the apartment confirmed provided such alternative allocation has at least the same maximum occupancy and is of similar overall quality.

3.6 When two or more consecutive weeks have been booked at an Affiliated Resort you may be required to move from one apartment to another for any second or any subsequent week.

3.7 The resorts have a minimum age requirement. At least one member of the party must be over 21 years of age for travel in Europe and at least one member (and in some cases ALL members) of the party must be over 23 years of age for all other areas.

4. CANCELLATION OF BOOKING

4.1 If you cancel your Booking

All confirmed bookings are non-refundable, non-changeable and non-transferable by you.

4.2 If we cancel your Booking

All reasonable endeavours will be made to provide the booking as advertised. However, as arrangements in relation to the provision of bookings are made many months in advance, they are, therefore, subject to change. We reserve the right in any circumstances to cancel your booking. In particular we may cancel your holiday before the scheduled departure date in the case of unusual and unforeseeable circumstances beyond WORLDWIDE HOTELS ONLINE control, the consequences of which could not have been avoided even if all due care had been exercised, or an event(s) which WORLDWIDE HOTELS ONLINE or the supplier of services even with all due care could not foresee or forestall. Such circumstances or event(s) amounting to situations of Force Majeure - e.g. war, threat of war, riot, civil commotion or unrest, industrial dispute, terrorist activity, fire, adverse weather conditions, natural or nuclear disaster, epidemics and all similar events beyond WORLDWIDE HOTELS ONLINE control. In any of these instances, where the booking has to be modified or cancelled, WORLDWIDE HOTELS ONLINE will try to offer suitable alternative arrangements, without being able to guarantee such, or otherwise will make a full refund of all monies paid.

5. LIMITATIONS OF LIABILITY

5.1 Any complaints about Holiday Accommodation or the services provided at an Affiliated Resort must be made at the earliest opportunity to a person in authority at the Affiliated Resort itself. If this does not produce a satisfactory result, WORLDWIDE HOTELS ONLINE should be contacted as soon as possible. WORLDWIDE HOTELS ONLINE accepts no liability to you or members of your holiday party for any costs and expenses incurred by you or them (including without limitation the costs of alternative accommodation) without prior authorisation from WORLDWIDE HOTELS ONLINE in relation to any complaints about holiday accommodation or the services provided at an Affiliated Resort. In the unlikely event that the Affiliated Resort does not resolve the matter, you should write to WORLDWIDE HOTELS ONLINE Customer Services department giving full details of the complaint within 30 days of your return. We reserve the right to refuse to consider any complaints made where this procedure has not been followed.

5.2 WORLDWIDE HOTELS ONLINE accepts no liability for the acts and omissions of any third parties providing products or services to you or members of your holiday party outside the scope of your booking.

6. GOVERNING LAW AND DISPUTES

6.1 These Terms and Conditions shall be governed by and be construed in accordance with the laws of England, whatever the nationality of the customer. In cases of conflict or inconsistency, where these Terms and Conditions are translated into a language other than English, the English text shall prevail.

6.2 You agree that the English courts shall have jurisdiction to resolve and determine any disputes that arise in connection with these Terms and Conditions.
